The BC Energy Regulator (Regulator) will no longer accept the Access to Crown Land for Offsite Investigation Application Form from permit holders who require use of Crown land for investigative purposes. This form has been removed from the Regulator’s website and clarification has been added to the Site Remediation and Reclamation Manual.
Where entry onto Crown land for investigative purposes cannot be adhered to, as per s.8.3 of the Crown Land Permissions Policy, an authorization under the Land Act or under s.138 of the Petroleum and Natural Gas (PNG) Act is required, subject to any terms or conditions the Regulator considers appropriate. This includes temporary use of Crown land for investigation of associated oil and gas activities and/or ancillary sites (such as a remote sump). An application for Associated Oil and Gas Activity with a land use type of Investigative Use is submitted through the Application Management System (AMS).
Additionally, if offsite remediation is required, an authorization under the Land Act or under s.138 of the PNG Act is required, subject to any terms or conditions the Regulator considers appropriate. An application for Associated Oil and Gas Activity with a land use type of Site Remediation is submitted through AMS.
The Oil and Gas Activity Application Manual should be followed when applying for the right to occupy Crown land.
